JCSPGG in suspicious fear pens Chief Justice over misconduct of Chilima

Joint Civil Society Platform on Good Governance has surprised the nation with suspicious claims alleging that Saulos Chilima , a first petitioner in the Constitutional case met with some judicial staff.

The NGO allege that the meeting took place at his area 43 residence in Lilongwe.

The organization chair Undule Mwakasungula, called upon the Country’s Chief justice to investigate the said claims.

In a letter dated 8 January 2020 signed by JCSPGG Chairperson Mwakasungura the meeting took place in Lilongwe at the residence of UTM president Dr Saulos Chilima on Thursday 2 January 2020.

Through the letter JCSPGG says it finds it “very strange” that judicial staff would be meeting a party to the very contentious electoral case.

“With all due respect to the fairness of your noble office. We as a Civil Society group would like to call upon your lordship to institute an investigation and provide the nation information about a meeting between judicial staff led by the publicity Secretary of the judicial workers union, Mr Andy Haliwa and Dr Saulos Chilima the first petitioner of the electoral case under the constitutional reference case number 1 of 2019” reads the letter in part.

The group also claims to have received information that Dr Chilima bankrolled the meeting.

“We are informed by people who were part of the delegation thatt Dr Chilima footed the bill covering travel and other logistics of the meeting which was aimed at the latter thanking the judicial staff for not staging any strike during the proceedings of the electoral case.

“Your lordship we find the reason behind the meeting and timing problematic since when do parties to a case invite staff to thank them for doing their job? Do judicial staff report to people outside judicial services and especially parties to a very prickly elections case? it reads.
The letter further says the organization can not rule out sabotage of the court process hence the need for the encounter to be investigated.

“Your lordship we therefore humbly request your noble office to investigate and furnish the nation names of the judicial staff who attended the meeting, the purpose of the meeting and what was discussed and agreed on the meeting.
while at it can be possible to state whether the meeting was ethical or not for interested party in this case to be holding meetings with judicial staff at this time when the nation is waiting for determination of the case.
Does that not compromise the integrity of the court”reads the letter in part.

Malawians went to the polls in May 2019 where they chose a president whose results opposition parties has challenged in court.

The case is expected to end between January or early February.
