Kaphale withdraw his statement during crossexamining of Chakwera

Attorney General Kalekeni Kaphale this morning made slunderous accusation against a pannel of judges accusing the same of overprotecting the witness.
“Seems you are overprotecting this witness unlike Dr Chilima coz we were able to cross examine him freely, giving me one day to cross examine him including making cross references,”
Judge Dr Kapindu interjected by informing Kaphale that what is happening was agreed and was dully communicated.
Judge Dingiswayo Madise came in asking the AG to withdraw the whole statement on overprotection to which he obliged.
“Can you withdraw what you have said, do you mean we are overprotecting this witness basing that you have been given one day?” He said.
Earlier the day the court gave Kaphale only one day to crossexamine Second respondent.
MEC on 27 May 2019 declared President Peter Mutharika winner of Malawi’s second tripartite elections held on May 21, against a backdrop of political violence as results delayed with a court injunction and opposition claims of vote-manipulations.
Mutharika, a candidate for Democratic Progressive Party (DPP) won with just under 51 per cent of the vote after polling 1 930 Million votes representing 38 percent, to 1 781Million votes representing 35.41% percent for his main rival Malawi Congress Party (MCP) torchbearer Lazarus Chakwera while on a distant third, former vice president Saulos Chilima polled 1,018,369 votes representing 20.24 percent .
Since then the demonstrators led by activists Timothy Mtambo and Gift Trapence have been organing the demonstrations to force Jane Ansah out of office as Chairperson.
It is believed that MEC declared Mutharika while there are 147 complaints.
Earlier the day Constitutional Court gave Kaphale one day to finish crossexamining second petitioner Lazarus Chakwera.
Reading the house keeping and court direction in court , Judge Healy Potani said the process will allow the speedy trial of the case.
Potani said seven days to crossexamine one witness as demanded by second respondent is just just too long.
But Kaphale interjected asking the court for consideration in number of cross examination days.
After reading the order Kaphale started crossexamining Second petitioner Lazarus Chakwera.
Kaphale started asking general questions such as his qualifications in which Chakwera said he holds Bachelor Degree from University of Malawi, Masters Degree from University of South Africa and PHd from USA.

Soon after the morning break people from the gallery heckled Kaphale after he slured that Chakwera need a bottle of water to clear and amplify his voice.
After the heckle , Judge Ivy Kamanga warned the gallery not to interject in court.
She said gallery has no powers or right to speak in court.
